The copyright and all other rights in the material on these Sites are owned by Bauer Consumer Media or are included with the permission of the owner of the rights. As a visitor to these Sites, you may download a single copy of the material for your own private viewing purposes only. RAIL Competition Terms and Conditions
 
These rules apply to all prize promotions including free draws, prize competitions and instant win offers.
  1. Unless stated otherwise, the Promoter is Bauer Consumer Media Limited.
  2. Entrants must be over 18 and resident in the UK. Employees/families/agents of the Promoter and its associates are not eligible. One entry per person/per household.
  3. No purchase is necessary.
  4. Details of winner can be requested in writing.
  5. Prize is subject to availability/may be substituted. No cash alternative/prize is non-refundable/non-transferable.
  6. The promoter accepts no liability for lost/damaged/incomplete entries. Proof of entry is not proof of delivery.
  7. The winner may need to sign statement of eligibility/liability/publicity release.
  8. Third party’s T&Cs may apply.
  9. Details of entries will be kept on a database and may be used and passed to third parties to enable the processing of Competition/prize fulfilment/where entrant has consented to share this information with other companies for marketing.
  10. To the extent permitted by law, the Promoter excludes all liability for any loss in connection with the Competition.

E-commerce Terms and Conditions

1. CARRIAGE & DELIVERY
  • RAIL reserves the right to charge carriage on deliveries as appropriate.
  • Delivery dates are given in good faith by RAIL to indicate estimated delivery times but shall not amount to any contractual obligation to deliver at the times stated in any communication by and on behalf of RAIL.
  • No liability for direct or consequential loss or damage arising from delay in the delivery of goods, including without prejudice to the generality of the foregoing any delays due to any Act of God, war civil disturbance, strikes, lock-outs or any act outside RAIL control, will be accepted.
  • The customer shall : -
    • Check all goods delivered and sign the delivery note for the goods in the presence of the driver.
    • Mark any discrepancies between goods ordered and goods delivered on the consignment note prior to signing.
    • Refuse any goods found to be damaged and mark the consignment note accordingly.
  • Any claims over damaged goods or discrepancies between the goods listed on the delivery note and the goods delivered to the customer must be submitted to RAIL with the full particulars of the order, the delivery note and any other relevant information in writing within 5 working days of the delivery, failing to do this RAIL cannot accept liability. The submission of a claim within this time limit does not necessarily mean that RAIL will accept liability in relation to such claim. A consignment note signed unexamined is not sufficient to uphold a claim
  • RAIL shall not be liable for any loss resulting from the customer's failure to comply with the requirements of the Road Carriers or the Post Office regulations.
  • If the customer does not receive the goods within 14 days of the date of invoice, he is required to notify RAIL immediately thereafter; otherwise no liability can be accepted.
2. GUARANTEES
  • RAIL gives no guarantee or warranty on goods supplied by RAIL other than that given that by the manufacturers concerned or as provided with the orders.
  • RAIL does not accept liability for consequential loss or damage arising from goods supplied by RAIL
  • All description, weights and dimensions issued by RAIL are approximate only and are intended only to present to intending customers a general description of the goods to which they refer, and no warranties or representations are given or should be inferred there from.
3. ORDERS
  • RAIL trading policy is only to supply bona fida trade customers against official customer orders. The proper control and authorisation of official orders is deemed to be the responsibility of the customers. RAIL cannot accept any liability for either the incorrect use or abuse of customer official orders.
  • RAIL reserves the right at any time and without explanation to:
    • Refuse to accept an order
    • Cancel an order
    • Suspend deliveries against an order whether or not an account is in arrears
    • Refuse cancellation of an order
    • Cancel unexecuted instalments of an order
  • No variation of an order will be recognised unless otherwise agreed by RAIL in writing.
  • All orders must be confirmed in writing by the customers and signed by an authorised signatory
  • RAIL retains the right to levy a handling charge where a customer cancels an order.
4. RETURNS
  • No goods may be returned by the customer without RAIL prior consent.
  • Goods returned for credit must be accompanied by a delivery note quoting the number of RAIL invoice against which the goods were originally supplied and the reason for return.
  • RAIL reserves the right to refuse any returns or refuse any credit for non-faulty returned goods, should those goods in anyway be unfit for resale. Unfit for resale being entirely at the discretion of RAIL.
  • RAIL reserves the right to invoice a restocking charge for any non-faulty returned goods.
  • Goods returned and found to be faulty will be replaced or credited at the customer's discretion and the costs of returning these items will not be refunded by RAIL.
  • No liability can be accepted for loss or damage to goods returned by the customer.
  • If there is a discrepancy between goods advised as returned and the actual goods received, RAIL will only credit the goods actually received.
  • Boxes, cases and pallets that have been charged to the customer will be credited in full when returned to RAIL in good condition, carriage paid, within fourteen days from the date of RAIL consent to return.
5. LAW
  • These conditions are subject to and shall be construed in accordance with the Laws of England and the parties submit to the non-exclusive jurisdiction of the Courts of England & Wales.

General 

From time to time, our Sites may publish articles or features, which some site visitors may find offensive. Bauer Consumer Media does not intend to offend and suggests that site visitors who find the tone or content of the sites offensive, no longer visit the sites. No responsibility is taken for any offense caused.
Nothing in these Terms of Use shall restrict or exclude any liability that Bauer Consumer Media has to any party. These Terms of Use shall be governed by English law and the courts of England and Wales shall have exclusive jurisdiction over any disputes arising in relation with these Sites.
